In order to make the divorce less painful on the kid the parents probably need to talk to each other instead of fighting and make the split as peaceful and civilized as possible. Instead of going to court and fighting over the child they should attempt to sort out a partial custody agreement before hand by themselves, we before they go fill out paperwork for divorce. They should have a prearranged agreement when they get married about getting divorced so they can split it up equally and fairly well they're still happy. It's better for the child for there to be even splitting of custody and the parents should make sure even if one of them has full custody that the child sees and is in contact with the other parent. It's unfair to the child to fight over them and the decision of where they live the child should be included on if they're old enough to comprehend what's going on. 


It's hard to say whether or not Joanna deserved custody because we did not see what else she did for her son and what she did do before she left him. But the fact is she did leave her own child. When she was leaving she told Ted that she was unfit to be a mother and that Billy would be better off with Ted. She was practically giving him the custody saying you're the rightful parent. I'd say she would not deserve the custody is how are we to know she'd be able to handle a job and taking care of a kid at the same time it's hard for one parent and she might not be able to handle it as well as Ted. If she truly wanted the custody and then she would've never left in the first place. Joanna claimed that Billy needed her. If he needed her how come she didn't take him with her?
 

Ted done a lot of things differently but you cannot change the past. He should've been listening to his wife from the beginning. Maybe take her out one night let her talk and leave Billy with a sitter. As a father he should have been there for his kid, no matter how busy he was he should've made time for Billy before Joanna left them. He should've been a lot more patient with Billy. By the middle of the movie he had the role of almost the ideal father who could take care of his son on his own. He did deserve the custody. He was putting Billy before everything including his job, himself, his career and reputation.  He even lost his job and got a worse one for the sake of Billy.
